The DOT SAP PROCESS

 

removal from your DOT safety-sensitive duties

If you are employed in a Department of Transportation safety-sensitive position that falls under the:

  • FMCSA - Federal Motor Carrier Safety Administration
  • FAA - Federal Aviation Administration
  • USCG - United States Coast Guard
  • FRA - Federal Railroad Administration
  • PHMSA - Pipeline and Hazardous Materials Safety Administration
  • FTA - Federal Transit Administration

and have violated the Federal DOT drug and alcohol regulations by testing positive for a controlled substance or prescription medication whose use is prohibited by the DOT, having an alcohol concentration of 0.04 or greater, refusing a test, not providing a specimen in a timely manner, and/or failing to take a test, then you must be immediately removed from your DOT safety-sensitive duties.


Required DOT SAP Evaluation referral sequence of events

Shortly thereafter, an employee must be referred for an evaluation if in the following situations: a positive drug test, an alcohol test with an alcohol concentration of .04 or greater, or a refusal to test in accordance with DOT Rules and Regulations. The SAP evaluator must follow the employee through the entire process until the time the employee is ready to return to work. Once the employee begins the process with one SAP, they must stay with that SAP throughout the process.

The following is a summary of what will occur:

  1. The Medical Review Office (MRO) will notify you that your test results are positive for drugs and/or a Breathalyzer Alcohol Technician (BAT) will notify you of a positive alcohol test.
  2. DOT mandates that you be referred to a SAP for an evaluation in resolving problems associated with misuse of alcohol or the use of controlled substances.
  3. When the SAP recommends treatment, your employer and you will be given a written recommendation specifying the approximate duration of treatment and the level of care.
  4. The SAP will provide you with the appropriate referral, which is consistent with clinically evaluated needs and will take into consideration your insurance coverage, your ability to pay for treatment, and employer’s policies regarding availability of a leave of absence.
  5. As a DOT client, you are expected to participate in treatment as outlined by the treatment provider and the SAP. If you resist or fail to comply, the treatment provider will discharge you for non-compliance. This course of action will prevent you from working in a safety sensitive position.
  6. The SAP will hold a follow-up evaluation to review your compliance with the initial treatment recommendation. You will be required to follow the treatment provider’s recommendation for continuing care and meeting attendance.
  7. If you have been terminated from employment and would like to pursue the evaluation in hopes of obtaining another safety-sensitive position the SAP recommendation may be provided to you and a copy retained for any future employer.
  8. The SAP will submit in writing to your employer a summary outlining the initial assessment and participation in treatment. The SAP will also recommend to the employer that you pass a return to duty test for drugs or alcohol, plus order the mandated DOT follow-up testing schedule.

Typical DOT SAP Recommendations

Appropriate education, treatment and follow-up testing may include, but is not limited to:

  • Alcohol and Drug Information School.
  • Recovery and/or Self-help groups and community lectures that can be verified. 
  •  In-patient hospitalization, partial inpatient treatment, or outpatient counseling programs and aftercare.
  • A minimum of six unannounced follow-up tests in the first 12 months of safety-sensitive duty following the employee’s return to safety-sensitive functions.

  • The total fee amount must be paid in person at the time of service.  
    • Cash, credit card, or debit are acceptable forms of payment.
    • Cash payments must be paid in the exact amount. I will not make change.
    • If you choose to use your debit or credit card a standard 3% processing fee will be added via Square or Quickbooks Payment systems.
    • If we make a mutual agreement, I will also accept payment in the form of ACH, debit, and credit card via electronic invoice. 
  • The evaluation fee is not billable to health insurance.
  • Employers may choose to pay for SAP evaluations.
    • I can only work with those arrangements if the employer contacts me directly.
  • EAP clients are responsible for fees or balances due in the event the EAP provider does not pay for part, or all services.

DOT Drug & Alcohol Awareness Training - 2hrs.

The DOT Alcohol and Drug Testing Regulations require a minimum of 60 minutes of alcohol and 60 minutes of drug awareness training for supervisors of safety-sensitive employees. This training is designed to help you meet DOT compliance training requirements for Reasonable Suspicion, as well as Drug and Alcohol Awareness.

DOT Supervisor Resonable Suspicion Training – 1hr.

Description: Provides support and training for supervisors that need to make a reasonable suspicion determination. Topics covered:

  • Effects of Drugs and Alcohol on the job
  • The Supervisors' role in a DOT Testing Program
  • Indicators, Signals, and Symptoms to look for
  • Prohibited Behavior, including how to handle Prescription Drug Use
  • How to Recognize and Document Performance using the Behavior Observation Checklist
  • Applying the Four Steps of Constructive Confrontation

Also how to handle:

  • Employee refusal to be tested
  • Supervisor receiving hearsay information
  • Employee discovery of a suspicious substance
  • Employees who leave the job site

  • Initial Evaluation can usually be offered within 24 to 48 business hours.
  • When we make appointments I am committing to holding that time for you. If a cancellation is unavoidable and my schedule allows, I will reschedule you for another time. Generally, I can be flexible about a missed appointment. If you are unable to keep your scheduled appointment for any reason, please give me at least 24 hours advance notice. If you do not show for an appointment without 24 hours notification then you will be charged a missed appointment fee, to be paid prior to scheduling your next appointment. The missed appointment fee is $75.
